Condos: How To Deal With A Bad Homeowners Association

The vast majority of people who live in condominiums never have a problem with their homeowners association. Each month, they write a check to the association, and they receive the variety of services covered by their association dues. There are steps that potential condo owners can take to ensure they do not buy a unit in a building that has a bad homeowners association, as well as steps they can take if they discover after the fact that their association leaves something to be desired.

Chat with potential neighbors
When you are in the process of deciding which condo building you want to live in, it is likely your Realtor can get you a list of the people who serve on the board of directors of the condo homeowners association. Talk to people who live in the building but do not serve on the board. Ask them if they have ever had any problems with the association, or know anyone who has.

Check the financials
In Minnesota and many other states, sellers are required to provide a complete set of the current financial statements of the association and other association documents. After coming to terms with a seller, you will have a certain period of time to look them over. Do it carefully. Does the association have sufficient reserve funds? That may prevent you from a big assessment if something should go wrong with the roof, for example. How often does the association raise the monthly fee? If the fee seems to go up by a large amount each year, it may be a sign that your association routinely spends more than it takes in.

Make your voice heard
If you have a problem with the association, go to its meetings and air your concerns. Talk to your neighbors and see if they have similar concerns. There is strength in numbers. You also should talk directly to individual members of the association board of directors. Whether you are talking to an individual or to the board as a whole, remember to be respectful.

Serve on the board
If you truly want a voice in the operation of your association, run for a spot on the board. It is the best way to ensure your opinions are known, but serving on the board also gives more weight and validity to your complaints. It is often easy to criticize a condo homeowners association from the outside, but it is something altogether different to actually serve on it. By doing so, you can help shape the association and change it from the inside out.

Check the documents
You may not like what your association does, but whatever it is doing may be perfectly in line with the association bylaws. As a buyer, it is your responsibility to know the rules that govern your association. But if your association is doing something it should not, or that breaks its own rules, you have every right to pursue a remedy.

How to buy a condo for you.

How To Buy An Assignment Condo

In the past few years, some cities around the world have experienced booming condo construction markets. These condos are purchased by investors from around the world in addition to some local end users. For investors who bought a new condo from a Developer several years earlier and whose current plans have changed, this is an opportunity to sell before they have to incur closing costs and Developer levies. For buyers who want a brand new condo without having to wait years for construction to finish, or who cannot find what they want in the resale market, Assignments offer a greater selection AND potential savings.

An "Assignment" means you are taking over the contract that the original purchaser holds with a Developer. This works really well if you have a large cash down payment available, although sometimes a smaller amount can be negotiated. Generally what happens is you pay an amount equivalent to the purchaser's deposits to the Developer PLUS the purchaser's profit (the difference between the original purchase price from many years ago and today's selling price). You then are able to move into the condo when it reaches the occupancy stage. When the building registers, you then take out a mortgage and pay the balance owing on the condo to the Developer.

It sounds complicated and it is. However, as long as you hire a real estate agent and a lawyer who are competent and experienced in handling Assignment sales, the process is very straightforward. The advantage to you is that the Assignment market tends to be a Buyer's Market -- there are often many listings in these markets and few buyers -- which means that you can often get a great deal on a brand new condo with little or no competition from other buyers.

That said, locating Assignment sales can be difficult. Generally, Developers do not allow Assignments to be advertised on the Multiple Listing Service systems so these listings are offered by brokerages as Exclusive listings. Some real estate brokerages hold a large number of Exclusive Assignment listings in-house. In addition, these brokerages network on a regular basis with other agents in their market who have Assignment listings, which makes it easier to find listings that meet a buyer's criteria.

Once an agent locates potential properties for you, if they are experienced in this area, they can help you understand the specific details offered by each Assignment such as purchase costs, closing costs, understanding floor plans, upgrades, and many other details. In some cases, the building may have reached occupancy and you can actually view the condo already built. In other cases, you will be buying from Developer plans just like buying a pre-construction condo.

When you are ready to make an offer on an Assignment, you'll need a carefully structured Assignment contract. You then need to work closely with your Buyer's Agent, your lawyer, the Developer's office, and the listing agent to make sure your best interests are protected throughout the transaction.

The most important thing is to hire a Buyer's Agent, but be sure to ask them whether they have done an Assignment in the past and HOW MANY assignments have they done. Many agents have never done even one and you just might be their guinea pig!

5. You want to live in an urban area. Sure, you probably can find condos in rural areas, but the vast majority of condos are in heavily urbanized areas where there simply is not enough space for a bunch of single-family homes.

6. You like activity. Metropolitan areas are busy places, and in many of them, the action never really ceases. So if you want the option of going out in the middle of the night and not being completely alone, an urban condo just may be your cup of tea.

7. The view. From the standpoint of living somewhere with an excellent view, it is hard to beat an upper level of a condo building that scrapes the sky.

8. Options. Just like in single-family homes, you have plenty of options as far as what goes in your condo. Want to change the flooring? Go ahead. Replace the countertops? That is OK, too.

9. You want security.
Most condo buildings have one key to get in the front door, and another to get into your unit. That makes life more difficult for thieves, for example.

10. Convenient access. Many condos are very close to a wide variety of transportation types - from public transit to highways - so it is easy to get just about anywhere you need to go.
